1. PARTIES
This User Agreement (“Agreement”) is entered into between otopatron.com (“OtoPatron”) and the individual or legal entity (“User”) receiving services through the www.otopatron.com website and mobile applications (“Platform”).
2. SUBJECT AND SCOPE
This Agreement sets out the conditions under which the User may use the cloud-based car wash and service management software services (“Service”) provided by OtoPatron, together with the parties' rights and obligations.
3. CONDITIONS OF USE AND OBLIGATIONS
3.1. The User represents and undertakes that all information provided when registering with the Platform is accurate, complete and up to date. The User is solely responsible for any damage and legal or criminal liability arising from incorrect or incomplete information.
3.2. The User is personally responsible for the security of the username and password used to access the account. OtoPatron cannot be held responsible for damage arising from sharing these details with third parties or their use by unauthorised persons.
3.3. The User may use the Platform only for lawful purposes. The User bears legal and criminal responsibility for all transactions and actions performed through the Platform.
3.4. OtoPatron is not responsible for the content of data entered into the system by the User, including customer information, vehicle plates and financial records. The User is entirely responsible for the accuracy and lawfulness of data entry.
4. SERVICE FEES AND PAYMENT
4.1. Use of the Platform is based on a paid subscription under the selected package. The User must pay the specified subscription fees on time.
4.2. If payment is not made on time, OtoPatron reserves the right to suspend the User's access to the Service temporarily.
5. DATA RETENTION AND DELETION (IMPORTANT PROVISION)
5.1. If the User has not paid by the end of 60 (sixty) days following suspension of the account for non-payment, all data belonging to the User, including customer records, transaction history, staff data and all other information entered into the system, WILL BE PERMANENTLY AND IRREVERSIBLY DELETED from OtoPatron's servers.
5.2. The User acknowledges, represents and undertakes in advance that, once the 60-day period has expired and the data has been deleted, they may not demand data recovery, compensation or any other entitlement from OtoPatron.
6. LIMITATIONS OF LIABILITY
6.1. OtoPatron provides the Service “as is”. It does not guarantee that the Service will be uninterrupted, error-free or 100% secure. OtoPatron cannot be held responsible for data losses resulting from technical failures or force majeure.
6.2. OtoPatron shall not, under any circumstances, be liable for the User's loss of business profit, loss of data or indirect damage.
7. INTELLECTUAL PROPERTY
All intellectual property rights in the Platform's software and design and in the “OtoPatron” trademark belong to otopatron.com.
8. AMENDMENTS AND EFFECTIVE DATE
8.1. OtoPatron reserves the right to amend the terms of this Agreement unilaterally at any time without giving prior notice to the User.
8.2. Changes take effect on the date they are published on the website. By continuing to use the Platform, the User is deemed to have accepted the amended terms in advance.
8.3. The User is responsible for reviewing the provisions of the Agreement regularly.
